Terms and Conditions

General T&C's. The Goods are sold by STAIRS ONLINE PTY LTD to the Client subject to these terms and conditions, and not otherwise. These terms and conditions prevail over any provision in any communication by the Client to STAIRS ONLINE PTY LTD about the sale of the Goods, including any form of purchase order issued by the Client. All risk in the Goods passes to the Client upon delivery of the Goods by STAIRS ONLINE PTY LTD to the Delivery Address or the Client.  STAIRS ONLINE PTY LTD takes no responsibility for installation by other trades / individuals who do not follow these specifications. STAIRS ONLINE PTY LTD must be notified in writing for any rectification work required prior to the installation of any fittings and fixtures. Delivery to site - Clear access and storage in adjacent space to the final location is required. Delivery dates are estimates only and we are unable to accept any liability for failure to deliver the products within the specified time resulting from shipment/delivery delays from our suppliers. Delivery times will be arranged with you in advance. If you are unable to accept delivery within 3 days from our agreed delivery date, the invoice must then be paid in full. In addition, a minimum storage fee of $100 per week will be payable. Storage fees will be invoiced to you on a weekly basis until delivery has been completed and are payable prior to final delivery. If there is no one available to accept delivery on the pre-arranged delivery date, you will be charged for transport and re-delivery costs. You are responsible for ensuring that there is adequate access and entry to your premises to allow delivery of the products. Any additional costs in relation to access into your premises, e.g., crane, are your responsibility. If it is not possible for the products to be delivered into your premises, the products will be returned to our warehouse and you will be invoiced for transport and re-delivery. In addition, the above storage charges will apply. We reserve the right to make part deliveries of any order and each part delivery shall constitute a separate contract in respect of the products delivered on the same condition as set out herein. Failure to deliver all the products you have ordered shall not invalidate the contract as regards any part deliveries. All products will remain the property of STAIRS ONLINE PTY LTD until payment is received in full and delivered from STAIRS ONLINE PTY LTD premises. Should you be arranging your own delivery then the goods become your responsibility upon collection from STAIRS ONLINE PTY LTD premises. STAIRS ONLINE PTY LTD products must not be subject to misuse, negligence or modifications; damage caused by misuse of the product including wear and tear or shrinkage, movement of any materials or fittings by which their nature or use could be expected to shrink, move or damage to the product exposure to moisture, cleaning chemicals, sunlight, artificial lights, heat, humidity, air conditioning or residential household heating is not covered by warranty. Once items are onsite it is the clients responsibility to protect the items, Gyprock dust, concrete dust and debris but not limited to can cause major defects to the items. Please note that timber and timber composites are prone to movement and can be expected in varying climatic conditions, timber and timber veneers are natural products and are subject to variation in colour, tone, grain pattern and may vary from samples or images representing the material; sealing these materials and products may alter the above. STAIRS ONLINE PTY LTD products voids all warranty if its products are repaired or modified by an unauthorised or unqualified agent. Timber samples are indicative only. Timber is a natural product and hence may vary from sample to full-size in terms of colour and grain. A sample does not properly represent the appearance of a full-size product. Timber may have natural and manufacturing features such as knots, gum, figure, sloping grain, varying leaf-widths, join lines, paling fence effect and knife rub marks. Additionally, the type of clear-coating/lacquer, incidental light exposure, high humidity/water/alcohol/cleaning products/oils/food debris may affect the appearance and integrity of the product. Costs of goods from sub-contractors or material/hardware suppliers are subject to increase without notice; STAIRS ONLINE PTY LTD reserves the right to pass on any increases to client. Defect liability period of 7 days applies from delivery. Cancellation of items: if any item is cancelled at any point after engagement, STAIRS ONLINE PTY LTD reserves the right to charge any associated costs (drafting, site measure) allocated to the item at the time of cancellation.
STAIRS ONLINE PTY LTD reserves the right to vary the product specifications without notice. The liability of STAIRS ONLINE PTY LTD in respect of a breach of a consumer guarantee or any warranty made under these conditions of sale for any goods not of a kind ordinarily acquired for personal, domestic or household use is limited, to the extent permitted by law and at the option of STAIRS ONLINE PTY LTD to:
(a) replacing the goods or the supply of equivalent goods;
(b) the repair of the goods;
(c) the payment of the cost of replacing the goods or of acquiring equivalent goods; or
(d) the payment of the cost of having the goods repaired.
To the extent permitted by law, all other warranties whether implied or otherwise, not set out in these conditions of sale are excluded and STAIRS ONLINE PTY LTD is not liable in contract, tort (including, without limitation, negligence or breach of statutory duty) or otherwise to compensate the customer for:
(a) any increased costs or expenses;
(b) any loss of profit, revenue, business, contracts or anticipated savings;
(c) any loss or expense resulting from a claim by a third party; or
(d) any special, indirect or consequential loss or damage of any nature whatsoever caused by STAIRS ONLINE PTY LTD failure to complete or delay in completing the order to deliver the goods.
No waiver of any of these conditions of sale or failure to exercise a right or remedy by STAIRS ONLINE PTY LTD will be considered to imply or constitute a further waiver by STAIRS ONLINE PTY LTD of the same or any other term, condition, right or remedy.
